By accessing our website and/or purchasing from us, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy.

1. Online Store Terms & Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to Australian copyright and consumer protection laws).

2. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded. Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

3. Fulfillment & Supply Chain Disclosure

Skylaire operates as a modern e-commerce brand. To provide our Australian customers with a diverse selection of high-quality products at competitive prices, we utilize a global fulfillment model. Orders are processed in Canada and dispatched via international distribution centres. All brand management, administrative services, and customer support operations are headquartered in Ottawa, Canada.

4. Pricing, Payments & Taxes (DDP)

  • Currency: All prices are displayed and processed in Australian Dollars (AUD).
  • Taxes & Duties (DDP): Skylaire operates on a Delivered Duty Paid (DDP) basis. For Australian orders, prices include GST (Goods and Services Tax) and all applicable import duties. The price you see at checkout is final; you will not face additional "fees at the door" upon delivery.
  • Modifications: We reserve the right to modify prices or discontinue services without notice.

5. Order Acceptance & Billing

We reserve the right to refuse or cancel any order. You agree to provide current, complete, and accurate purchase and account information for all transactions. By placing an order, you authorize us to charge your selected payment method.

6. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to infringe upon our intellectual property rights; (c) to submit false or misleading information; or (d) to upload or transmit viruses or any other type of malicious code.

7. Limitation of Liability

To the extent permitted by law (and subject to your rights under the ACL), Skylaire, our directors, or employees shall not be liable for any injury, loss, claim, or any direct, indirect, or consequential damages of any kind arising from your use of the service or products procured using the service.

8. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New South Wales, Australia.
